This website, marie-makes.co.uk (“the Site”), is owned and operated by Marie Sanders, trading as “Marie Makes” (“we”, “us”, “our”), a sole trader of 7 Hale Avenue, Stony Stratford, MK11 1EP.

These Terms and Conditions apply whenever you browse the Site or buy Products (baked goods) from us. By placing an order, you agree to be bound by them. Please read them before ordering. This document is only available in English.

You must be at least 16 years old to place an order. If you’re under 16, a parent or guardian must place the order on your behalf and takes full responsibility for it.


1. Using the Site

Access to the Site is provided on a temporary basis. We may restrict, withdraw, or amend the Site or any part of it at any time, and we won’t be liable if the Site is unavailable for any period.

2. Orders

  • Placing an order is an offer to buy — it isn’t confirmed until we send you an Order Confirmation email, which is issued once we’ve received payment in full. This is when a binding contract is formed.
  • Spotted an error in your Order Confirmation? Let us know via our contact page at least 48 hours before your order is due (7 days for bespoke orders).
  • Want to cancel? Let us know via our contact page at least 48 hours before your order is due (7 days for bespoke orders). Refunds go back to the account or PayPal used to pay.
  • Want to change your order (add items, change date/time)? Contact us via our contact page at least 7 days before your order is due. We’ll do our best to accommodate you, kitchen space allowing.

3. Price and Payment

  • Prices are as shown on the Site at the time of order, except in cases of an obvious pricing error – we’re not obliged to honour an incorrect price, even if we’ve already invoiced you.
  • We are not VAT registered, so no VAT is added to our prices.
  • Prices can change at any time, but never for an order you’ve already received an Order Confirmation for.
  • Payment is by card or PayPal only. A receipt is included with your Order Confirmation.
  • For bespoke orders, we require a non-refundable deposit to secure your booking, with the balance due 7 days before delivery. The deposit is retained by us in all circumstances, including if you later cancel or reduce your order, and is separate from the refund position set out in Section 6.
  • If your card issuer or PayPal declines or delays a payment, we’re not liable for any resulting delay to, or non-delivery of, your order.

4. Delivery

  • Products are delivered to the address you provide, within the time slot we confirm to you.
  • Missed delivery (no one available to receive it): we attempt delivery to a neighbour and if there is nobody available, we’ll take the Products back and hold them for 24 hours, during which you can contact us via our contact page to arrange a further delivery attempt (additional charge may apply).
  • To receive an order, you (or your recipient) must visually inspect the Product at the point of delivery to confirm it is complete and in good condition. Once you accept the Product, responsibility for it passes to you – see Section 5.

5. Risk & Ownership

  • Products are at your risk from the moment we deliver them to you.
  • Ownership passes to you only once we’ve received payment in full.

6. Cancellations, Refunds & Returns

Because our Products are handmade to order, this policy is a little different from off-the-shelf retail:

  • Before delivery: cancel in line with the notice periods in Section 2 for a full refund, except for any non-refundable deposit paid (see Section 3).
  • At delivery: please visually inspect your order before accepting it. If it doesn’t match what you ordered, you can refuse it there and then for a full refund. Once you (or your recipient) have accepted the order, the points below apply.
  • After acceptance, we’re not able to offer a refund or exchange based on subjective matters of taste, decorating style, wording, or colour shade – these are inherently a matter of personal preference, and we’ve made every reasonable effort to match your brief. Please also note that screen displays vary, so colours on screen may not exactly match the finished Product.
  • Damage after delivery: once an order has been accepted as complete and undamaged, we’re not responsible for damage occurring afterwards (e.g. during storage). We’ll give you clear instructions on handling and storing your cake – please follow these carefully, as cakes are fragile.
  • Genuine quality issues (e.g. there’s a fault in the bake): contact us within 24 hours of delivery via phone or email. Please bring the Product back to us so we can assess it. Refunds or store credit for upheld quality issues are assessed case by case.
  • We don’t offer refunds once a Product has been consumed, or for claims raised more than 24 hours after delivery.
  • This policy doesn’t affect your statutory rights.

7. Changes to These Terms

We may update these Terms and Conditions from time to time — for example, to reflect changes in the law, our systems, or how we do business. Any order you’ve already received an Order Confirmation for will be honoured under the Terms that applied when you placed it, unless a change is required by law.

8. Your Responsibilities

By using the Site, you agree that:

  • The personal details you give us are accurate, and any payment method you use is your own (or you have permission to use it, with sufficient funds available). We don’t store your card, bank, or PayPal details on the Site.
  • It’s your responsibility to keep your contact details up to date so we can reach you about your order.
  • We handle your personal data in line with UK data protection law (the UK GDPR and the Data Protection Act 2018) and our Privacy and Cookies Policy.
  • We may withdraw from an order if a Product was inaccurately described or an obvious error was made.
  • You won’t copy, reproduce, or commercially reuse any content from the Site (text, images, logos) without our permission.
  • You’re responsible for keeping your own devices secure; we can’t be held responsible for viruses or similar issues arising from your use of the Site.

9. Your Device & Internet Access

You’re responsible for having a device, internet connection, and system capable of browsing and ordering from the Site. We can’t guarantee the Site will display or function identically across all browsers and devices.

10. Misuse of the Site

We may suspend or restrict your access to the Site if we reasonably believe you’re in breach of these Terms, and won’t restore access without our agreement. Please don’t use the Site to send unsolicited communications or for anything outside its intended purpose.

11. Liability

  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.
  • Beyond that, our liability to you for any breach of these Terms is limited to the price you paid for the relevant Product.
  • We’re not liable for losses caused by Site downtime, technical faults, or matters outside our reasonable control.
  • The Site is provided “as is.” We take reasonable care to keep it accurate and secure, but can’t guarantee it will always be error-free.
  • We may withdraw a Product from sale, or modify or discontinue the Site, at any time.
  • Links to third-party websites are provided for convenience only – we don’t control or take responsibility for their content.

12. Intellectual Property

All content on the Site – text, images, logos, and graphics – belongs to us and is protected by law. You may view, print, or save pages for your own personal, non-commercial use (e.g. as a record of your order), but you may not otherwise copy, reproduce, or reuse Site content without our permission.

13. Allergens & Food Safety

  • Our baked goods are freshest on the day of delivery and will keep for a further 72 hours if stored at ambient temperature in the box provided. Products kept longer than this, or refrigerated/frozen, are at your own risk.
  • We list known nut content on individual Product pages, but our kitchen does handle nuts, so we can’t guarantee any Product is completely free of traces. If you have an allergy, please contact us before ordering.
  • Please raise any issue with a Product within 24 hours of delivery – see Section 6.

14. General

  • If any part of these Terms is found invalid or unenforceable, the rest will remain in effect.
  • These Terms, and any dispute relating to them, are governed by the laws of England and Wales, and the English courts have exclusive jurisdiction.
  • The Contracts (Rights of Third Parties) Act 1999 doesn’t apply to these Terms – they’re for the benefit of you and us only.
  • You agree to cover any reasonable costs we incur as a direct result of your breach of these Terms.
